United Rocks Waiver

Please read this document carefully.

This program is a rock-climbing team organized by United Rocks, a non-profit 501(c)(3) which goal is to promote physical, mental and social skills through the sport of rock climbing for individuals with intellectual and developmental disabilities.

The climbing gym is the hosting facility for the practices taking place once a week for 2 hours (referred to in this document as “gym”). The activities to be performed during rock-climbing practices organized by United Rocks, include artificial wall climbing on fixed walls (including top-roping).

In compliance with State and Federal regulations, any adult (referred to in this document as “volunteer”) must sign this document, as evidence of their agreement to these terms and conditions, for themselves.

The “volunteer” acknowledges and agrees with the following:
  • Are responsible for managing the risks of the activities and the premises, supervised or not, and must follow all “gym” policies and rules.

  • Hereby acknowledges the risks associated with the activities described above, and that other risks, inherent and otherwise, may be encountered, and expressly assumes such risks, on behalf of him/herself.

  • Agrees for his/herself and, to the maximum extent allowed by law, to release and discharge United Rocks, its owners, staff and volunteers, from all claims, liabilities, and losses asserted by or on behalf of me in any way arising from or connected with their participation to the climbing gym, the use of its equipment and facilities, or otherwise being on the premises of the gym on such dates. I understand that by signing this document, I surrender my right to make a claim or file a lawsuit against United Rocks, its owners, staff and volunteers for personal injury, illness, property damage, wrongful death, products liability or any other theory, to the maximum extent allowed by law.

  • I further agree to hold harmless and indemnify (that is, defend and pay or reimburse) United Rocks, its owners, staff and volunteers from any claim and from any liability, loss, damages or expenses (including attorneys’ fees and insurance deductibles) resulting from 1) a claim brought by a participant or any other person for loss or damage caused by my acts or missions; and 2) a claim brought by me in any way arising out of my participation in an activity sponsored by United Rocks, the use of equipment and facilities, or otherwise moving about the premises of the gym.

  • In the event that I should require medical care or treatment, I authorize United Rocks, its owners, staff or volunteers to seek immediate medical attention and I agree to be financially responsible for any costs incurred as a result of medical attention or treatment. I am aware and understand that I should carry my own health insurance.

I have carefully read, understand and voluntarily agree to this agreement and acknowledge that it shall be effective and binding upon me, who is a volunteer.

Photo/Video Waiver

This form indicates approval for the participants picture, voice, verbal statements, or portraits (video or still) to appear in marketing materials, videos, or internet posts on the climbing team’s web site and in media covering UNITED ROCKS’ events.

For example, pictures and articles about climbing activities may appear in local newspapers or publications.

These pictures and articles may or may not personally identify the participant. Participant and parent/guardian understand and agree that: consent and release have been given without coercion or duress.

This agreement is binding upon heirs and/or future legal representatives; and the photo, video, or participant statements may be used in subsequent years.

UNITED ROCKS has no control of media use of pictures/statements that are taken without permission.
